Claims for damages against The Company which result from use or non-use of available information or incomplete or incorrect t information are excluded in principle if it cannot be proofed that Baumann Immobilienkanzlei GmbH GmbH did use the information in a deliberate and negligent manner. General Terms and Conditions for contracts of property agents (instructions of a property buyer)

1. By obtaining or getting knowledge of our property information (e.g. through internet or other publications) we, the company Baumann Immobilienkanzlei GmbH as an agent, offer you a property (called “the property for sale”) with conditions as published. Your acceptance of our offer will be made through establishing contact with us or with the vendor.

2. Information you obtained from our exposes or through our activity as an agent are strictly confidential. In case of a break of confidentiality we reserve the right to claim damages – in particular loss of commission in case a contract was completed through third parties.

3. In case “the property for sale” is already known to you, you are obliged to inform us in writing also stating your source of information. In case of non compliance with this obligation to inform we reserve the right for damages.

4. You agree that we will also be acting for your contract partner – the vendor- against remuneration.

5. The areas stated in the exposes of “the properties for sale” represent the summary of the areas of the individual rooms. The areas in the basements or cellars and in the loft are according to § 53 LBO – building regulations- not to be considered as living areas.

6. Side agreements, changes or supplements of the contract have to be made in writing. Cancellation of the contract with us has to be made in writing.

7. Agreements and contracts between the parties are governed by and construed in accordance with Swiss Law. Courts of jurisdiction is Ascona.

8. The Company is only liable for damages of injuries to life, body and health as a result of a deliberate and neglible breach of duty through Baumann Immobilienkanzlei GmbH or for damages which are the result of intended and highly neglible actions by Baumann Immobilienkanzlei GmbH. This applies also for any legal representative of the Company. Any further liability of the Company is excluded.

9. In case some of the terms and conditions of these General Terms And Conditions become invalid or unlawful it will have no effect to the remaining terms of a contract. The invalid or unlawful terms will be replaced by the then new valid and lawful terms.
